Terms of Service

These are the terms for using Brainchild. They are short on purpose. If anything is unclear, ask us before you sign up.

1. Who we are

Brainchild Technologies ("Brainchild", "we") is based in Karachi, Pakistan. You can reach us at [email protected] or on WhatsApp at +92 300 8935001. These terms apply to any business ("you") that uses Brainchild.

2. What Brainchild does

Brainchild gives your business an AI agent that answers your customers on WhatsApp, by phone and on your website. It answers from the information you give us, can take orders and bookings, follows up with customers, passes conversations to you when a person is needed, and reports back to you.

3. Connecting your WhatsApp

  • You must be allowed to connect the WhatsApp number and Meta business account you choose.
  • You must follow the WhatsApp Business Policy and Meta's Commerce Policy, and only message customers who have agreed to hear from you.
  • Meta charges its WhatsApp fees directly to you. Those are separate from our fees.
  • The agent does not reply to anyone until we have set it up with you and you have agreed to switch it on.

4. Your information stays yours

Your products, prices, policies and customer conversations belong to you. We use them only to run Brainchild for you and to improve the quality of its answers. Our Privacy Policy explains how we handle them.

5. What the agent says

  • The agent answers from the information you give us. You are responsible for keeping prices, stock and policies correct and up to date.
  • AI can make mistakes. The agent is set up to pass anything it is unsure about to you, but you should check orders before you send them and tell us about any wrong answer so we can fix it.
  • You decide the agent's rules, such as discounts, delivery charges and what needs your approval.

6. Fees

Our fees are the ones we agree with you in writing. If we change them, we will tell you at least 30 days before the change.

7. What you may not use Brainchild for

You may not use Brainchild to send spam, mislead customers, sell anything illegal, harass anyone, or break any law or Meta policy. We may pause your agent if we see this, and we will tell you why.

8. Keeping it running

We work to keep Brainchild running at all times, but we cannot promise it will never stop. It depends on services we do not control, such as WhatsApp. If something goes wrong, we will tell you and fix it as quickly as we can.

9. Limits on our responsibility

As far as the law allows, we are not responsible for indirect losses, such as lost profit or lost sales, and our total responsibility to you is limited to the fees you paid us in the three months before the problem. Nothing in these terms limits anything the law does not allow us to limit.

10. Ending

You can stop using Brainchild at any time by telling us. We may stop providing it if you break these terms, with notice unless the breach is serious. When you stop, we disconnect your number and delete your data as described on our Data deletion page.

11. Changes and law

If we change these terms, we will update this page and tell businesses using Brainchild. These terms are governed by the laws of Pakistan, and the courts of Karachi decide any dispute.
